Personal Data Processing Policy

In this document you will find information about the processing of personal data by PLAYzone s.r.o., Company ID: 28399510, with registered office at Vinohradská 3217/167, Prague 10 – Strašnice, postcode 100 00, registered in the Commercial Register kept by the Municipal Court in Prague under file no. C 138766 (hereinafter "PLAYzone"), in connection with registration on the PLAYzone.cz portal and/or in the PLAYzone arena, as defined below.

Basic terms

  1. To begin with, we would like to inform you about some basic terms used in this notice, which are also defined in Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 94/46/EC (the "GDPR").
  2. "Personal data" means any information relating to an identified or identifiable natural person. This is a person who can be identified, directly or indirectly, in particular by reference to an identifier (name, company ID, location data, network identifier).
  3. "Data subject" is the specific person whose personal data is concerned in a given case.
  4. "Processing" means any operation or set of operations performed on personal data (e.g. recording, organising, storing, etc.).
  5. "Controller" is the person who determines the purposes and means of processing personal data.
  6. "Processor" is the person who processes personal data on behalf of the controller.
  7. "Recipient" is the person to whom the personal data has been disclosed.
  8. "Consent" of the data subject means any freely given, specific, informed and unambiguous indication of the data subject's wishes by which they signify agreement to the processing of their personal data.
  9. "PLAYzone.cz" is a gaming portal at http://playzone.cz focused on supporting and developing online games in the Czech Republic and Slovakia.
  10. "PLAYzone Arena" is a gaming venue focused on e-sport (PC, VR, consoles and more) located in the Westfield Chodov shopping centre at Roztylská 2321/19, Prague-Chodov, postcode 148 00.
  11. "Customer" is a person who has registered on the PLAYzone.cz portal and/or in the PLAYzone Arena.

Purposes and legal basis for processing personal data

  1. Your personal data is processed by PLAYzone as the Controller, for the following purposes and on the following legal bases:
    1. for the purpose of performing the contract concluded between you and PLAYzone, either on the basis of registration on the PLAYzone.cz portal and/or on the basis of registration in the PLAYzone Arena;
    2. for the purpose of sending personalised marketing (commercial) communications from PLAYzone (e.g. information about special offers and events) on the basis of your voluntary consent (if you give such consent);
    3. for the purpose of compiling statistics on Customers using the PLAYzone.cz portal or the PLAYzone Arena, based on PLAYzone's legitimate interest in improving PLAYzone's services;
    4. for the purpose of fulfilling legal obligations arising from legal regulations (proving consent, etc.);
      for the purpose of enforcing or defending PLAYzone's legal claims, based on PLAYzone's legitimate interest in protecting its rights.
  2. In the case of processing personal data for the purpose of performing the contract (registration on the PLAYzone.cz portal and/or registration in the PLAYzone arena), providing your data is necessary for the conclusion and performance of the contract.
  3. PLAYzone obtains personal data directly from the data subject, i.e. from the Customer (or from their legal representatives). The data is obtained when the Customer enters it in the relevant online form when registering an account with PLAYzone.
  4. The Customer may give PLAYzone consent to receive commercial communications. Providing consent to receive commercial communications is entirely voluntary. Consent may be given only by a Customer who has reached the age of 15, by ticking the box with the text "I agree to receive personalised commercial communications" (or a box with text of similar meaning) in the relevant online form when registering on the PLAYzone.cz portal and/or registering in the PLAYzone arena. If no box is ticked in the online form, consent will not be given and PLAYzone will not process the Customer's personal data for the purpose of sending commercial communications.
  5. Granting consent is entirely voluntary and consent may be withdrawn at any time, by sending notice to the email address [email protected] or by clicking the link in each individual message, or by another method specified in a particular message. There are no financial or other penalties or other negative consequences for the Customer associated with refusing to give consent or withdrawing consent.
  6. PLAYzone's goal is to send you information that interests you and not to burden you with communications that are not relevant to you. So that PLAYzone can offer you commercial communications that interest you, your personal data will, on the basis of the consent given, also be used for so-called profiling (e.g. according to the type of games played while using the gaming space in the PLAYzone arena, etc.).
  7. Your personal data will also be processed for the purpose of fulfilling legal obligations arising from legal regulations, namely for the purpose of proving the consent given.

Categories of personal data

  1. For the purposes set out in Article 2, PLAYzone processes in particular the following data:
    1. identification data (e.g. first name, surname, login name);
    2. contact data (e.g. address, email address);
    3. other data that you enter in the relevant form when registering to use the gaming space in the PLAYzone arena and/or on the PLAYzone.cz portal (Game IDs, social media profile addresses);
    4. data that PLAYzone obtains on the basis of profiling for the purpose of sending personalised commercial communications (e.g. classification into a sociodemographic group);
    5. if the Customer is under 15 years of age, also the identification and contact data of the Customer's legal representative.

Period of processing

  1. Your data will be processed by PLAYzone:
    1. for the purpose of performing rights and obligations under the contract, for a period of two years after the expiry of the limitation period for all claims that have arisen or could arise in connection with the contract;
    2. for the purpose of fulfilling legal obligations, for the period necessary under the relevant legal regulation that imposes the obligation on PLAYzone;
    3. for the purpose of defending PLAYzone's legal claims, for at least two years from the end of the limitation period for those claims;
  2. for purposes based on voluntary consent, for the period for which consent was given (i.e. in the case of sending personalised communications, for a period of 2 years from giving consent), but in all cases no longer than the period for which it is possible to process this data in accordance with valid and effective legal regulations. If you withdraw your consent to the processing of personal data given to PLAYzone, the data will be processed until consent is withdrawn (withdrawal of consent does not affect processing that took place before withdrawal). If you give consent to processing for several purposes and withdraw consent for only one of these purposes, your data will continue to be processed for the purposes for which you have not withdrawn consent.

Source of data

  1. PLAYzone obtains personal data from you, when you provide it in the relevant online form when registering an account with PLAYzone, or on the basis of in-person registration together with your legal representative when registering to use the gaming space of the PLAYzone arena, or which it obtains in another way in connection with the processing of data on the basis of the consent given (e.g. processing of cookies stored in connection with completing an online questionnaire, etc.).

Recipients and processors of personal data

  1. The personal data you provide may be further passed on/made accessible to other recipients. These include, for example, PLAYzone's contractual partners (IT service providers, or providers of tax, legal or other services), as well as public authorities (offices, courts, law enforcement authorities) and others.

Rights of data subjects

  1. PLAYzone processes personal data in relation to the data subject fairly and in a lawful and transparent manner. Data is collected for specified, explicit and legitimate purposes. PLAYzone ensures that personal data is accurate and, where necessary, kept up to date. PLAYzone has taken all reasonable measures to ensure that personal data which is inaccurate, having regard to the purposes for which it is processed, is erased or rectified without delay.
  2. The data subject may request information from and access to personal data from the controller in accordance with Articles 13 and 14 of the GDPR, in particular the right to request
    1. the identity and specific details of the controller,
    2. information about the purposes of processing for which the personal data is intended,
    3. access to the personal data,
    4. rectification, erasure or restriction of processing of the personal data,
    5. cessation of processing of the personal data.
  3. The data subject may also raise objections to the processing. If processing is based on consent (Article 6(1)(a) or Article 9(2)(a) of the GDPR), the data subject has the right to withdraw consent to the processing of personal data, without affecting the lawfulness of processing based on the consent given before its withdrawal.
  4. If you believe that your data is being processed by PLAYzone in breach of legal regulations, you can lodge a complaint with the supervisory authority – the Office for Personal Data Protection. However, in the interest of arranging a remedy as quickly as possible, we recommend that you first contact PLAYzone.
  5. If you have any questions regarding the processing of your personal data or the personal data of your legal representative, or if you wish to update or correct your personal data, or if you wish to request its erasure or restriction of processing, or if you wish to raise an objection to processing, please contact PLAYzone through the contacts given in Article 3.

Protection of personal data

  1. PLAYzone cares about protecting the rights of data subjects and the proper security of personal data, and therefore, when processing personal data, ensures, through appropriate technical and organisational measures, the highest possible level of security corresponding to the possible risks of the relevant processing.
